1. About Lami.ph
Lami.ph is a community food marketplace that connects home cooks ("Sellers") with buyers in their neighborhood. Lami.ph provides the platform - listings, ordering, and payment facilitation - but does not prepare, handle, package, or deliver any food itself.
2. Information We Collect
To operate the marketplace safely, we collect and process the following information when you register as a Seller:
- Identity verification data - a photo of your government-issued ID and a live selfie (facial image), captured and processed by our verification partner Didit. We store the result of the verification (approved or declined), not your ID images.
- Mobile number - verified by one-time SMS code, used for account sign-in, order notifications, and as your store's contact number shown to buyers.
- Name and email address - used for your account and communications from Lami.ph.
- Store details and location - your store name, description, operating hours, address, and the map location you pin, which are shown to buyers so they can find and order from you.
- Order and transaction data - orders received, amounts, and payout details needed to run your store and pay you.
3. How We Use Your Information
We use this information to verify that Sellers are real, reachable people; to display your store to buyers in your area; to process orders and payouts; to send order and account notifications; and to keep the community safe. We do not sell your personal information. Identity verification is processed by Didit under their own privacy policy.
4. Your Responsibility for Your Food
As a Seller, you are solely responsible for the food you sell. By accepting these terms you acknowledge and agree that:
- You alone are responsible for the safety, quality, freshness, hygiene, preparation, packaging, and accurate description of every product you sell.
- You are responsible for declaring ingredients and common allergens, and for honestly representing your food in photos and descriptions.
- You are responsible for complying with all applicable local laws and regulations, including any required permits, sanitary requirements, or barangay/city ordinances for selling food.
- Any complaint, illness, injury, loss, or damage arising from your products is your sole responsibility. You agree to handle buyer complaints and refunds for product issues promptly and in good faith.
- Lami.ph acts only as a marketplace platform and is not liable for the food Sellers prepare and sell. You agree to indemnify and hold Lami.ph harmless from claims arising from your products or your breach of these terms.
5. Orders, Payments, and Fees
Buyers pay through the payment methods available at checkout (e.g. e-wallet, card, or cash on delivery). Lami.ph charges a platform fee of 5% per completed order. For online payments, the fee is deducted before payout; payouts are sent weekly to your registered payout method.
For cash-on-delivery orders, the buyer pays you directly, so the platform fee is deducted from your prepaid Lami.ph credit balance. You must keep a sufficient credit balance to accept cash-on-delivery orders; if your credits run out, cash on delivery is disabled for your store until you top up. Credits from cancelled orders are refunded to your balance. You are responsible for any taxes on your earnings.
6. Account Suspension and Termination
We may suspend or remove a Seller account that receives repeated verified complaints, sells unsafe or misrepresented food, fails identity verification, or otherwise violates these terms or the law. You may close your account at any time; obligations arising from orders already placed survive closure.
7. Changes to These Terms
We may update these terms from time to time. We will notify Sellers of material changes through the app or by message to your registered contact details. Continuing to sell after changes take effect means you accept the updated terms.
